The entrance of Peruvian products to the US market and US products to the Peruvian market present different categories of tariff elimination:Lists A and F: Products will have duty free treatment on the date the Agreement enter into force (February 1, 2009).List B: Goods shall be duty free in 5 years. The import duties will be eliminated in five equal annual stages, beginning February 1, 2009.List C: Goods shall be duty free in 10 years. The import duties will be eliminated in ten annual equal stages, beginning February 1, 2009.List D: Goods shall be duty free in 15 years. The import duties will be eliminated in ten annual equal stages, beginning on February 1, 2009.List E: Goods shall be duty free in 17 years. In the first 10 years, beginning on February 1, 2009, the original import duties will be maintained. On the 11th year, the reduction of import duties will begin to be implemented in seven annual equal stages.
The majority of the Peruvian products, around 98% of goods, will have duty free treatment upon coming into effect the Peru FTA (categories A and F), that is since February 1, 2009 onwards.

REQUEST OF PREFERENTIAL DUTIES UNDER PERU FTA
After February 1, 2009, importers and brokers may file claims for preferential tariff treatment on goods that originate in Peru, placing on the entry document the Special program indicator (SPI) “PE” as a prefix to the HTS item number for each line on which preferential tariff treatment is claimed.
The importers of the United States will be able to request preferential tariffs based on a Certificate of Origin which can be issued by the importer, the exporter, or the manufacturer.
The FTA does not consider any special format of certificate of origin, but it does stipulate that there can be a communication, in printed or electronic form, which contains the following information:
- Name of the person who certifies
- The HTS tariff item and the description of the product
- Information which states that the product is native to Peru or the U.S.
- Date of certification
Exceptions: A certification or other information shall not be required for an importation of goods with an FOB value of $2,500.00 or less unless CBP considers the importation to be carried out or planned for the purposes of evading US laws and regulations.
importers are required to maintain records for five years after the date of importation, including the certification, and all records relating to the importation of the goods.In case of ATPDEA entries, the importer has to present the formal Certificate of Origin
